UN Process Moves Forward on Treaty for Free Education

A United Nations process is moving forward to consider a new legally binding treaty to strengthen children's right to free education. The proposed Optional Protocol to the Convention on the Rights of the Child would explicitly recognize early childhood care and education as part of the right to education, and guarantee free public pre-primary education, beginning with at least one year, and free public secondary education for all children.

The talks come as states weigh their next steps in the negotiation. Supporters say the protocol would close gaps in existing law, since the current convention does not spell out free pre-primary schooling or clearly cover the earliest years of a child's learning. Backers argue that access to education often depends on a family's income, and that a binding text would push governments to fund public systems rather than rely on fees.

Some delegations have raised questions about cost, implementation timelines, and how the treaty would apply in countries with limited resources. Others want clearer language on the role of private providers and on monitoring. Despite those differences, the process is advancing, with further discussions expected as states decide how to proceed.
